The examination of Roday Kennedy taken on oath this 18th day of March in the year of our Lord 1876 at London, in the City aforesaid, before the undersigned, [illegible]of Her Majesty's Justices of the Peace for the said City & County in the presence and hearing of James Donnelly who is charged this day before me for that he, the said James Donnelly at the Village of Lucan in the said County on the 28th day of January 1876 did assault beat and wound him the said Roday Kennedy.
This Depondent Roday Kennedy upon his oath, saith as follows:-
On the 28th day of January I had a warrant placed in my hand to arrest Robert and John Donnelly for the assault upon Peter McKellar & I was sworn as a special constable for the execution of that warrant. I got off the stage near one of the platforms at Robert McLeans Tavern in Lucan. I arrested Robert Donnelly on this warrant. He pulled out a Revolver and told me to let go of him. I had told him when I arrested him that he was my prisoner in the name of the Queen. I held on to him. He then struck me several blows with the revolver and wounded me severely. The Prisoner James Donnelly then caught me by my arm and told me to let him him go & kicked me severely in the body-and brought me down on my knees. Then Robert bit me with his teeth & took a piece out of my lip the scar of which now shown. I was severely beated by James and he was the means of Rescuing Robert from my custody and forcing him away from me. The other Donellys were standing by urging them on.
